March BJC 201 Focuses on Construction Contracts

March 2025 - A packed room of contractors, designers and construction professionals packed the March 18 BJC 201 to hear Aaron G. Weishaar, an attorney specializing in construction contracts, talk about opportunity and growth, as well as risks, challenges to maintaining defensible positioning and the constraints of navigating societal and industry norms that threaten the sustainability of small businesses. Weishaar said:

"In today’s construction market, projects are more elevated with respect to their level of difficulty, complexity and risk. For a small business, participating in these projects potentially exposes your business to the same level of risk as the larger prime contractors and consultants. Before you agree to participate as a strategic partner, subcontractor or subconsultant, you must complete your due diligence to determine if the contract opportunity aligns with your business model, growth objectives and available resources. Always review the critical imperatives when managing contract risk. These important factors include: (thorough risk assessment, identifying potential issues early, ensuring clear contract language, engage in effective communication between all parties, contingency planning, monitoring of work progress, quality checks, corrective measures, and implementation of appropriate mitigation strategies based on the risks identified; all while ensuring compliance with contract terms to avoid disputes.)"
